Welcome to the Aitom AI Agent Service. By subscribing to and using our services, you (the User) agree to comply with and be bound by the following terms and conditions as stated below by us (the Service Provider). Your continued use of the service implies your acceptance of these terms and any future modifications.

1. Internet Connectivity: The Aitom AI Agent Service requires a stable and continuous internet connection for optimal functionality. The User is responsible for their own internet connectivity and any associated costs.
2. AI Conversational Responses: The Aitom AI Agent Service employs an AI Large Language Model (LLM) for its conversational features. While the Service Provider has diligently endeavoured to optimize the accuracy of AI responses, the User acknowledges the inherent, non-deterministic nature of AI and that the AI may generate unexpected or unintended responses.
3. Third-Party Services: The Aitom AI Agent Service may rely on services from reputable third-party tech providers, such as Google, Microsoft, Meta, Amazon, Anthropic, OpenAI and others, for its underlying functionalities. While these third-party service providers maintain a high degree of reliability, the User acknowledges that instances of downtime may occur in our product when the services provided by these third-party entities become temporarily unavailable, and any interruptions caused by their unavailability are beyond our control.
4. Account Credentials: Users are responsible for maintaining the confidentiality of their account credentials. Users should promptly report any unauthorized access or suspicious activities related to their account to the Service Provider.
5. Intellectual Property: The Aitom AI Agent Service and its constituent technologies are protected by intellectual property laws. Users are granted a limited, non-exclusive license to use Aitom AI Agent Service for its intended purpose.
6. Data Privacy and Security: The User's data is managed in strict compliance with applicable privacy and data protection laws. Although the service provider diligently implements robust security measures, users are encouraged to exercise due diligence in safeguarding their data.
7. Limitation of Liability: The User acknowledges and agrees that the Service Provider assumes no responsibility for any direct, indirect, incidental, or consequential damages resulting from the utilization or unavailability of the Aitom AI Agent Service. In circumstances requiring compensation, the Service Provider's liability shall not exceed the total subscription costs paid by the User for the relevant subscription period.
8. Termination: The Service Provider reserves the right to terminate or suspend user accounts in the event of terms violations or improper use.
9. Updates and Changes: The terms and conditions may be updated, and users are encouraged to review them periodically. Users will be notified of significant changes to the terms.
10. Governing Law: The terms and conditions are governed by the laws of Singapore, and any disputes are subject to the exclusive jurisdiction of the courts in Singapore.

Generative AI Terms of Use

The product's (Aitom Gen. AI solutions) terms of use outline the user's responsibilities (Customers, partners, and any companies or personal that use a license copy of the Aitom Gen AI solutions) and Anewtech Systems Pte Ltd legal obligations, including limitations on liability, ensuring that Anewtech Systems Pte Ltd is not held responsible for any indirect, incidental, or consequential damages arising from the use of the product (Aitom Gen AI solutions) , while clearly stating that the user must comply with all applicable laws and regulations.

These Generative AI Terms of Use (“AI Terms”) govern your access to and use of:

(a) Integrated Gen AI: Third-party generative AI technology integrated with our Software, typically accessed via an API.

(b) Embedded Gen AI: Third-party generative AI technology embedded directly within our Software.

Your use of Integrated Gen AI and Embedded Gen AI is subject to these AI Terms. Unless explicitly stated otherwise, other agreements you have with us do not apply to your access and use of Integrated Gen AI and Embedded Gen AI.

Integrated Gen AI
Our Integrated Gen AI connects third-party generative AI tools (such as from Microsoft, Google, Meta and OpenAI) with our Software. The functionality of Integrated Gen AI may be limited as described in the Software Documentation and user manual that is provided to the customers or any one company who purchased the license Aitom Gen AI solution.

You are responsible for obtaining any necessary licenses for third-party generative AI tools and for complying with their terms. You must also adhere to all applicable laws and regulations of Singapore or your own country or region, including data protection and privacy laws, in your use of Integrated Gen AI.

Nothing in your agreements with us applies to your use of third-party generative AI tools. We are not liable for any third-party tools or services and disclaim all responsibility for their outputs.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES AND REMEDIES ARE EXCLUDED, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF INTEGRATED GEN AI. OUR MAXIMUM LIABILITY FOR DAMAGES ARISING FROM YOUR USE OF INTEGRATED GEN AI SHALL NOT EXCEED $100 SGD.

Embedded Generative AI
Certain Software solutions may include Embedded Gen AI technology from third parties (e.g. Microsoft, Google, Meta and OpenAI). This Software is identified by terms like “with AI” in its name.

Your use of Embedded Gen AI is governed by:

1. These AI Terms.
2. The Software Transaction Agreement which is the purchase order or purchase contract issue to Anewtech by any customers, companies or individual for the license copy of our Aitom solutions, which includes the Data Processing Addendum (“DPA”) and relevant Documentation, collectively referred to as the software transaction agreement “STA”.

In case of conflict between the STA and these AI Terms, the AI Terms will prevail. Capitalized terms not defined here have the meanings set forth in the STA.

Embedded Gen AI is not intended for processing Personal Data, health information protected by HSA or Ministry of Health, or other sensitive data. You are solely responsible for how such data is used with Embedded Gen AI.

Customer Data processed by Embedded Gen AI may be handled by the third-party provider according to the STA.

You acknowledge that the legal framework around Artificial Intelligence may evolve. We may limit, modify, or discontinue any Embedded Gen AI features or functionality based on changes in applicable law at our discretion.

You are responsible for ensuring compliance with all relevant IT and use of media laws in Singapore , particularly data privacy laws, in your use of Embedded Gen AI.

You understand and agree that content generated by Embedded Gen AI (“Output”) has not been verified or endorsed by us. This Output may not be accurate, complete, or current, and is provided "as is" without any warranties.

Reliance on the Output is solely at your discretion. You should independently verify any Output for accuracy regarding your specific use cases.

You acknowledge that (i) Output may not be eligible for intellectual property protection; (ii) similar Output may be produced in response to similar requests from other users; and (iii) your rights to Output may not be enforceable against others.

Your ownership of any information in the Output is subject to our and/or our licensors' ownership rights in the Products and Pre-Existing Materials used to train Embedded Gen AI. You are granted a license to use Pre-Existing Materials in the Output only as permitted for the Product.

Service levels or credits do not apply to disruptions caused by Embedded Gen AI.

NOT WITHSTANDING ANYTHING TO THE CONTRARY IN THE STA OR ANY OTHER AGREEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES AND REMEDIES ARE EXCLUDED. OUR MAXIMUM LIABILITY FOR DAMAGES FROM YOUR USE OF EMBEDDED GEN AI SHALL NOT EXCEED $100 SGD.
